These Terms of Use are an agreement between you and Hideaway Labs ("Overdue", "we", "us") covering the Overdue app and the youreoverdue.com website. By creating an account or using the service, you accept these terms and our Privacy Policy. If you use Overdue through the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies to the extent it is not in conflict with these terms.
Overdue lets you pick a photo, decorate it, and have us print it and mail a physical copy to someone you choose. Printing and delivery are handled by our third-party print and mail partner and by postal carriers, so timing and handling are partly outside our control.
We can't guarantee delivery dates or condition in transit. Mail can be delayed, misrouted, or damaged. We'll do our best to make it right if something goes wrong, but Overdue is a way to send real mail, not a guaranteed courier service.
You must be at least 13 years old to use Overdue. You are responsible for the accuracy of the information you provide, including the recipient's mailing address, and for keeping access to your account secure. We may suspend or terminate accounts that violate these terms or abuse the service.
Sending a physical photo is a paid order. The price is shown before you confirm, and payment is charged through our payment processor at the time you place the order.
You keep ownership of the photos you upload. By using Overdue you give us the limited license we need to store your photos, apply the decorations you add, and print and mail them, as described in our Privacy Policy. You confirm that you have the right to use and send every photo you upload, and that you have the right to send mail to the recipients you choose.

We use automated screening and human review to help detect content that breaks these rules, and we may refuse, hold, or cancel any order and remove any content we believe violates them or misuses the service to harass or harm someone. Screening is a safeguard, not a guarantee, and does not make us responsible for content you submit. We have zero tolerance for child sexual abuse material; we will remove it, terminate the account, and report it to the National Center for Missing & Exploited Children and law enforcement as required by law.
If you believe someone has used Overdue to send you or another person abusive, harassing, or otherwise violating content, report it to overdue@hideawaylabs.io and we will review it promptly.

The Overdue app, website, brand, and everything in them (other than your content) belong to Hideaway Labs and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own or control, as permitted by the applicable app store terms.
Overdue is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any given item will arrive by a particular date or in perfect condition.
To the maximum extent permitted by law, Hideaway Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of Overdue. Our total liability for any claim relating to a send is limited to the greater of $50 or the amount you paid us for the order the claim relates to. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
We may update the service and these terms over time. If we make material changes to the terms, we will update the date above and notify you in the app or by email. If you keep using Overdue after changes take effect, you accept them. You can stop using Overdue and delete your account at any time; we may suspend or end the service, or your access to it, with reasonable notice where practicable.
These terms are governed by the laws of the United States and the state in which Hideaway Labs is organized, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in that state, unless applicable law gives you the right to a different venue.
